Effective, well-managed electronic discovery is essential in nearly all litigation, and especially so in bankruptcy cases. There, massive quantities of relevant electronic data and paper records – coupled with crushing and omnipresent deadlines – can trigger unexpected release of privileged information and embarrassing, expensive delays and missteps.

Moreover, the ground rules for e-discovery are changing. On December 1, amendments to the U.S. Federal Rules of Civil Procedure will alter the way you must retain and delete data. Among other requirements, the new rules compel both parties to discuss as early as possible the location of important data and develop a data retrieval plan. Parties also must produce data in a “reasonably usable” format.

How can you and your clients cope with this quagmire? Order this Audio CD Recording (recorded October 2006) and let Steven C. Bennett – one of the nation’s most recognized authorities on electronic discovery and records management – help you fine-tune your management of paper and electronic records.

In just 90 minutes, you and an unlimited number of your staff will examine –

• Lessons learned – where and how to identify best practices in records management
• Standardization – do standard forms exist, and are they widely accepted by courts and agencies?
• Essentials – “must haves” for your records management program. What ultimate purposes should your program serve?
• Design and Management – how should your records management program be designed and implemented, especially under the new rules?
• Adaptability – what changes when a company becomes involved in litigation?
• Pitfalls – where do most e-discovery programs go wrong? What practices should you avoid?
